Maryland AG launches investigation after man dies in custody

The Independent Investigations Division investigates all police-involved incidents that result in a death or injuries likely to result in a death of an individual occurring in the State of Maryland.

The death of a man in police custody in Gaithersburg, Maryland, is under investigation by the Independent Investigations Division (IID) of the Maryland Office of the Attorney General, according to a news release.

The Gaithersburg Police Department received a report about a man causing a disturbance Tuesday night.

Officers found Marvin Salamanca Garcia, 35, covered in blood and lying on the ground in front of an apartment building when they arrived about 10:15 p.m. in the 300 block of N. Summit Avenue, the attorney general's office said. Police said Garcia was acting erratically, but authorities didn't include specific details.

According to a preliminary investigation, Garcia stood up and walked away from the apartment building at one point. Officers then grabbed him and put him on the ground, according to the attorney general's office.

As officers held Garcia on the ground, he lost consciousness and stopped breathing, the attorney general's office said. Officers gave him first aid until fire and rescue units arrived to take over. They took him to a hospital, where he died Thursday, two days later.

On Monday, the attorney general's office released Garcia's name and the officers involved. The officers include: as Sgt. Evan Milano, Cpl. Doug Seek, Officer William Diggons, Officer Kelvin Colon, Officer Nick Ozkayan, Officer Anna Reckley and Officer Jaime Flores-Rios.

Body-worn camera footage is usually made public within 20 business days of an incident, but there may be situations when more time is needed, the Maryland Attorney General's Office said.

The IID previously investigated a fatal vehicle incident in Gaithersburg last May.
