Virginia AG: Pollution Board Can Regulate Carbon Emissions

RICHMOND, Va. (AP) — Virginia Attorney General Mark Herring says the State Air Pollution Control Board has the power to regulate carbon emissions from existing power plants and set a statewide carbon cap.

It’s a legal opinion a top Democratic lawmaker said could lead to stricter state pollution limits at a time when President Donald Trump has vowing to roll back the federal Clean Power Plan that aims to reduce harmful emissions.

Herring issued a legal opinion Friday saying current law grants the board power to treat carbon dioxide as air pollution and regulate it. State House Minority Leader David Toscano, who asked for the opinion, said it opens the door for the volunteer board to take much broader steps than they currently are to curb emissions.
