A federal judge rejected efforts by prosecutors to revoke Marion Barry's probation and send him to jail for repeatedly filing his income taxes late.
The judge also rejected prosecutors' request to place Barry on home detention or electronic monitoring.
Federal magistrate Deborah Robinson did extend Barry's probation until March 2011 because of the complaint.
Barry, who served four terms as mayor and represents Ward 8 on the D.C. Council, pleaded guilty in 2005 to a misdemeanor charge of failing to file federal and local tax returns and was placed on probation.
He has been late filing more recent returns, prompting prosecutors to seek jail time for Barry. A court hearing was held April 16 and the judge released her order Friday afternoon.
